Terms of Usage

Effective Date: July 1, 2025

These Terms of Usage (“Terms”) govern your access to and use of DRR.center and the DRR Applications. By accessing or using our services, you agree to be bound by these Terms.

1. Definitions

• Services – DRR.center and all DRR Applications.
• User – Any person accessing or using the Services.
• CSSPI – Climate Survival Solutions Philippines, Inc.

2. License and Access

Subject to compliance with these Terms, CSSPI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for disaster risk reduction purposes.

3. User Conduct and Restrictions

You agree not to:

• Use the Services for fraudulent, malicious, or unlawful purposes.
• Upload or transmit harmful, false, or misleading data.
• Attempt unauthorized access, reverse engineering, or disruption of the Services.
• Misrepresent your identity or provide false information.

Any misuse constitutes a material breach and may result in:

• Immediate suspension or termination of access.
• Reporting to authorities.
• Civil or criminal liability, including potential lawsuits.

4. Media Content Rights

All photos, videos, or recordings captured or uploaded through the Services shall be deemed assigned and licensed to CSSPI, DRR.center, and Government Entities with the following rights:

• Irrevocable, worldwide, royalty-free license to use, copy, adapt, publish, and share such Media Content.
• Right to integrate Media Content into reports, systems, training, and emergency response.
• Authority to share Media Content with Government Entities and the public when necessary.

5. Intellectual Property

All intellectual property related to the Services, including logos, software, databases, and content, is owned by CSSPI or its licensors. Unauthorized use is prohibited.

6. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, express or implied. CSSPI makes no guarantee regarding:

• Accuracy, reliability, or timeliness of information.
• Availability or uninterrupted operation.
• Security of transmissions or stored data.

7. Limitation of Liability

To the maximum extent permitted by law, CSSPI shall not be liable for:

• Indirect, incidental, or consequential damages.
• Loss of data, business, or goodwill.
• Unauthorized use or misuse of the Services.

8. Indemnification

You agree to indemnify, defend, and hold harmless CSSPI, its officers, employees, and partners against any claims, damages, liabilities, or expenses arising from your misuse of the Services or violation of these Terms.

9. Termination

CSSPI may suspend or terminate your access without prior notice if you violate these Terms. Upon termination, you must cease all use of the Services, but Sections 4–9 shall survive termination.

10. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Republic of the Philippines. Any dispute shall be submitted to the exclusive jurisdiction of the courts in Cebu City, Philippines.

11. Amendments

CSSPI reserves the right to amend or update these Terms at any time. Updates will be posted on DRR.center, and continued use constitutes acceptance of the revised Terms.

12. Severability

If any provision of these Terms is held invalid, the remaining provisions shall continue in full force and effect.
